Company Regulations

The draft regulations have been published for comment.

The draft Regulations deal with the functions of the Companies Commission, the Takeover Regulation Panel and the Companies Tribunal, as well as other matters relating to the regulation of companies, to take effect upon enactment of the Companies Act, 2008.

Comments should be directed to Mr Desmond Ramabulana on or before 31 January 2011 via e-mail: companiesregulations@thedti.gov.za.

Effective date - 2008 Companies Act

November 23, 2010

After numerous dates have been published as the effective date for the 2008 Companies Act, the new effective date is April 2011.

There were many issues wich companies would have to make decisions on so the time until the Act comes into force should be used wisely.  There is a transitional period within the companies would have to ensure compliance with issues, such as the new Memorandum and Articles of Association.
